DMCA Policy

Codio.site respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted the following policy regarding copyright infringement.

If you believe that your copyrighted work has been copied and is accessible on Codio.site in a way that constitutes copyright infringement, you may notify us by providing our Designated Copyright Agent (as identified below) with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the website are covered by a single notification, a representative list of such works on our site.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., a URL or specific description).
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature (typing your full legal name is sufficient).

You acknowledge that if you knowingly materially misrepresent that material or activity is infringing your copyright, you may be liable for damages (including costs and attorneys’ fees) incurred by us or our users as the result of our reliance on such misrepresentation.

Notice and Takedown Procedure

Upon receipt of a valid DMCA notice, we will:

  • Expeditiously remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material of the takedown and the DMCA claim.

We reserve the right to remove any content at our sole discretion, even if no DMCA notice is received.

Counter-Notification

If you believe that your content was removed by mistake or as a result of misidentification, you may send a counter-notification to our Designated Copyright Agent containing the following:

  1. Your physical or electronic signature (typing your full legal name is sufficient).
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material previously appeared (e.g., a URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Santa Clara County, California, if your address is outside of the United States), and that you will accept service of process from the complainant who submitted the DMCA notice.

Upon receipt of a valid counter-notification, we may restore the removed material within 10-14 business days unless our Designated Copyright Agent receives notification from the copyright owner that they have filed a lawsuit seeking enforcement of their copyright.

Repeat Infringers

We may terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers under the DMCA. We may also, at our discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Changes to This Policy

We may update this DMCA Policy from time to time. We will notify you of any material changes by posting the updated policy on this page. Your continued use of Codio .site after such changes constitutes your acceptance of the revised policy.
